First, The Difference Between DWI and DUI

These aren’t the same offense. They are different infractions with different penalties. Each is based on blood alcohol concentration (BAC).

DWI is driving while impaired. Its less serious than DUI and exists when the driver’s BAC is between 0.07 percent and 0.08 percent. Drivers are charged with DWI when a breath test is just below the legal limit but fail a field sobriety test or are driving erratically. The penalty for a first offense DWI is up to 60 days in jail and a $500 fine. Convicted drivers will receive an eight-point penalty on their license from the Motor Vehicle Administration (MVA), which is enough to lead to a license suspension.

DUI is driving under the influence. That means the driver’s BAC is 0.08 percent or higher. The penalty for a first time DUI is up to one year in jail and a $1,000 fine. The MVA puts 12 points on the license of those convicted of DUI, enough for revocation.

The laws for DWI and DUI also apply to illegal or prescription drug use.

Some have been court-ordered to take the program; others are required to do so in order to apply for a new license. Certain individuals are required to attend an alcohol treatment program in addition to an educational program. The Bergand Group offers both, each certified by the state of Maryland.
