When someone drives under the influence of drugs or alcohol, they run the risk of getting a DUI (driving under the influence) or DWI (driving while intoxicated) charge. Whether the charge is considered a DUI or a DWI depends on state laws. In some states the terms are interchangeable, while in others a DWI refers to a driver charged with driving while their blood alcohol content (BAC) is over the legal limit and a DUI refers to a charge of driving while under the influence of alcohol or drugs. As confusing as the legalities surrounding DUIs and DWIs seem, the important thing to remember is that both are illegal and both are unsafe.

What Steps Should be Taken After Receiving a DUI/DWI Charge?

After being charged, there are several steps to take after a DUI. In addition to complying with the arresting officer(s) and submitting to field sobriety tests, it’s best to follow the steps outlined below.

1. Obtain Legal Counsel

The legal process can be hard to navigate after receiving a DUI and the chances of severe backlash from the incident may be minimized with legal representation.

2. Attend a Court Date

When being charged with a DUI, the arresting officer provides the driver with a summons to appear in court. Attending the court date is crucial to clearing one’s name and with legal representation, it’ll go much smoother.

3. Carry Out the Sentence

A DUI sentence may involve paying fines, doing community service, alcohol education classes or even jail time. Complying with the terms of your sentence is crucial to getting your license back and avoiding further punishment.

4. Comply With the State’s Insurance Laws

In some instances, insurance carriers will cancel an insurance policy after a driver has been charged with a DUI or DWI. In the event insurance is canceled, there are often terms to comply with in order to obtain valid insurance again.

Post-DUI Alcohol Education Programs
