What is the Difference between a DUI and DWI?

A DUI stands for Driving Under the Influence. A DWI stands for Driving While Impaired. Depending on which state you live in, these acronyms can be interchangeable for the same charge, or they are different offenses. In Maryland, a Driving While Impaired (DWI) is a lesser charge than Driving Under the Influence (DUI).

DUI means that an individual was under the influence of drugs or alcohol, to the point that they were incapable of making sound decisions, and drove or had the intention of driving. A DUI charge in Maryland is the highest charge and is not a misdemeanor. The DUI charge can include jail time, a $1,000 fine, and 12 points on a license which can result in the revocation or suspension of a license. If an individual was driving drunk with minors in the car, there are additional penalties.

A DWI charge is a lesser charge than a DUI, with the distinction being the level of intoxication of the driver. A DWI charge comes when an individual drove or intended to drive, with an alcohol limit that was on the legal limits or close to the legal limits. If an individual is driving under the influence of substances other than alcohol, the officer may distinguish between a DUI or a DWI based on how intoxicated you seem.

Steps to Take After A DUI?

Both DUI and DWI charges can come with mandatory DUI/DWI educational programs or mandated alcohol treatment or substance abuse treatment programs. Compulsory education or treatment programs can come as a result of the charge or are a requirement to restore a revoked license.

Some may choose to voluntarily participate in these programs if they feel they need help. Even if the state doesn’t enforce a DUI Education Program or a DUI Treatment Program, it’s likely a necessary step to take after receiving a DUI/DWI.
