DUI/DWI: What’s the Difference?

DUI

The federal BAC is set at 0.08%, but different states can decide to press charges on a driver with a BAC of 0.01% depending on the age of the driver. In Maryland, a driver can be charged with a DUI offense when they operate a vehicle with a BAC that exceeds 0.07%. A device known as a breathalyzer can be used to determine a driver’s BAC. In some instances, a driver can be charged with a DUI for driving erratically or being suspected of driving under the influence. An officer of the law can also perform a field sobriety test to determine the coherence of a driver.

DWI

A DWI, driving while impaired, is an offense a driver can be charged with for operating a vehicle while being intoxicated. Many states do not distinguish a difference between DUI and DWI charges, but Maryland is not one of these states. In the state of Maryland, a DWI is a lesser charge than a DUI.

In Maryland, there are 5 different types of DUI charges, including:

  • Driving under the influence of alcohol
  • Driving under the influence of alcohol per se
  • Driving while impaired by alcohol
  • Driving while impaired by alcohol and drugs
  • Driving while impaired by controlled dangerous substances

Different penalty standards are carried out depending on the severity of the charge.
